Welcome to Yoga with Regina (YWR). By accessing or using our services, including in-person classes, online classes, or digital products (collectively, the “Services”), you agree to these Terms of Service (“Terms”). Please read carefully. All references to Yoga with Regina or YWR throughout these Terms refer exclusively to the business owned and operated by Regina Padilla.

1. Digital Product Description & Usage

  1. YWR offers in-person and digital/online instructional services for personal, non-commercial use only.

  2. To access Services, you must provide minimal requested information to purchase. Upon purchase, you may have lifetime access to stream or download digital content.

  3. You are solely responsible for all activities conducted through your account or payment method.

  4. All access is non-transferable. Do not share your product links, credentials, or content with anyone else.

Prohibited Uses:
You may not, without prior written consent:

  • Store, copy, modify, or distribute any YWR content.

  • Compile or collect YWR content as part of a database or other work.

  • Use automated tools (e.g., bots, spiders) or manual processes to monitor, copy, or redistribute content.

  • Incorporate YWR content into another website, service, or commercial offering.

  • Reproduce, duplicate, sell, resell, or exploit content for commercial purposes.

  • Circumvent or disable digital rights management or security features.

  • Interfere with YWR operations or the safety of instructors.

  • Remove, alter, or obscure proprietary notices, including copyright.

  • Include personal information about others without explicit consent.

2. Copyright & Intellectual Property

  1. All content on YWR, including video, text, images, and materials, is the intellectual property of YWR and Regina Padilla.

  2. No rights are granted to users other than as expressly set forth herein.

  3. YWR respects the intellectual property of others and may terminate access for repeated copyright infringement.

3. Fees & Payment

  1. Content offered by or through YWR is available to you for a fee (“Paid Content”).

  2. Payments are processed via third-party providers (e.g., PayPal), and their terms and privacy policies also apply.

  3. YWR does not store payment information and is not responsible for errors by payment processors.

  4. Users are responsible for fees charged by ISPs, mobile carriers, or other third parties in connection with accessing Services.

4. Refunds & Cancellations

All purchases of Services, including digital products and in-person classes, are non-refundable. No credits will be issued for partially used content. Cancelations and refunds are non applicable.

5. Access & Modifications

  1. YWR does not provide any equipment, props, or materials suggested in online classes.

  2. YWR reserves the right to modify, suspend, or discontinue Services, in whole or in part, without notice. YWR will not be liable for any resulting damages.

6. Health & Safety

  1. Participation in YWR classes carries inherent physical risks.

  2. You must consult a physician before beginning any fitness or movement program.

  3. Use of YWR Services is at your own risk. YWR does not assume liability for injuries or health issues arising from participation.

7. Privacy

  1. YWR collects name, email and phone number when voluntarily provided.

  2. You may opt out of email communications at any time.

  3. We will not sell or share personal data without your consent, except as required by law or as necessary to provide Services.

8. Disclaimer of Warranties

YOUR USE OF YWR SERVICES IS AT YOUR SOLE RISK. Services are provided “as is” and “as available”. YWR, Regina Padilla, affiliates, licensors, and suppliers expressly disclaim all warranties, including but not limited to:

  • Merchantability

  • Fitness for a particular purpose

  • Title and non-infringement

  • Accuracy or completeness of content

YWR does not guarantee uninterrupted service or transmission of accurate data.

9. Limitation of Liability

To the maximum extent permitted by law:

  1. YWR, Regina Padilla, and affiliates are not liable for indirect, incidental, special, consequential, or exemplary damages, including physical injuries, loss of profits, goodwill, data, or other intangible losses.

  2. Maximum liability for any claim related to Services is the greater of:

    • The amount you paid for the Service, or

    • $10 USD.

  3. Each provision allocating risk is severable and essential to the Terms. Limitations apply even if a limited remedy fails its purpose.

10. Governing Law & Dispute Resolution

  1. These Terms are governed by the laws of State of Hawaii.

  2. Any disputes arising from these Terms or use of Services will be resolved exclusively in the courts of Hawaii.

11. Miscellaneous

  1. YWR may update these Terms at any time; continued use constitutes acceptance.

  2. If any provision is invalid or unenforceable, remaining provisions remain effective.

  3. Headings are for convenience only and do not affect interpretation.

By using Yoga with Regina Services, you acknowledge that you have read, understood, and agree to these Terms of Service.
